1826' 86 .ocn Co, Illinois S.S.SSby Mary A. tato n, Recorder Book: 4190 Page: 193 Receipt e: 11082 Recording Fee: 130.00 P.gee Recorded: 3 Authorized By Date Recorded: 1/5/2012 8:17:42 AM AMENDMENT TO CITY OF DECATUR/PINES SHOPPING CENTER REDEVELOPMENT AGREEMENT ' WHEREAS, the City of Decatur, Illinois, a municipal corporation ("City") and Niemann Holdings LLC, an Illinois Limited Liability Company ("Redeveloper") entered into a redevelopment agreement ("Agreement') dated November 30, 2009 for the redevelopment of a program area known as the City of Decatur/Pines Shopping Center Tax Increment Redevelopment Project Area located at the Pines Shopping Center, 2200 E. William St. WHEREAS, the City and redeveloper desire to amend Section 2.8.4, Timing of Phases with said sections to read: 2.8.4 Timing of Phases. Notwithstanding any requirements set forth in this Agreement, including the demolition requirements set forth in Section 2.8.3 above, the Redeveloper shall have until June 30 2012 to cause the demolition of the existing Family Dollar store building and attached structures on the Project Site as set forth above and to commence the construction of all phases of the Project except for the Save-A-Lot store and the site improvements related thereto. NOW, THEREFORE, the City and Redeveloper agree as follows: 1. Upon approval from the City Council, Section 2.8.4 of the redevelopment agreement shall be amended allowing the redeveloper to cause the demolition of the existing Family Dollar store building and attached structures as reflected on the preliminary plans and to commence construction of all phases of the Project except for the new Save.A.Lot store and the site improvements related thereto no later than June 30, 2012. 2. All other terms of the Agreement are hereby confirmed, and shall remain in full force and effect.
