1826' 86 .ocn Co, Illinois <br /> S.S.SSby Mary A. tato <br /> n, Recorder <br /> Book: 4190 Page: 193 <br /> Receipt e: 11082 Recording Fee: 130.00 <br /> P.gee Recorded: 3 Authorized By <br /> Date Recorded: 1/5/2012 8:17:42 AM <br /> AMENDMENT TO CITY OF DECATUR/PINES SHOPPING CENTER <br /> REDEVELOPMENT AGREEMENT ' <br /> WHEREAS, the City of Decatur, Illinois, a municipal corporation ("City") and <br /> Niemann Holdings LLC, an Illinois Limited Liability Company ("Redeveloper") entered <br /> into a redevelopment agreement ("Agreement') dated November 30, 2009 for the <br /> redevelopment of a program area known as the City of Decatur/Pines Shopping Center Tax <br /> Increment Redevelopment Project Area located at the Pines Shopping Center, 2200 E. <br /> William St. <br /> WHEREAS, the City and redeveloper desire to amend Section 2.8.4, Timing of <br /> Phases with said sections to read: <br /> 2.8.4 Timing of Phases. Notwithstanding any requirements set forth in this <br /> Agreement, including the demolition requirements set forth in Section 2.8.3 <br /> above, the Redeveloper shall have until June 30 2012 to cause the demolition of <br /> the existing Family Dollar store building and attached structures on the Project <br /> Site as set forth above and to commence the construction of all phases of the <br /> Project except for the Save-A-Lot store and the site improvements related <br /> thereto. <br /> NOW, THEREFORE, the City and Redeveloper agree as follows: <br /> 1. Upon approval from the City Council, Section 2.8.4 of the redevelopment <br /> agreement shall be amended allowing the redeveloper to cause the demolition <br /> of the existing Family Dollar store building and attached structures as <br /> reflected on the preliminary plans and to commence construction of all <br /> phases of the Project except for the new Save.A.Lot store and the site <br /> improvements related thereto no later than June 30, 2012. <br /> 2. All other terms of the Agreement are hereby confirmed, and shall remain in <br /> full force and effect. <br />
