DEVELOPMENT SERVICES MEMORANDUM <br /> No. 11-63 <br /> November 16, 2011 <br /> TO: Honorable Mayor Michael T. McElroy and City Council <br /> FROM: Ryan P. McCrady, City Manager <br /> Billy Tyus, Assistant City Manager <br /> SUBJECT: Amendment to Redevelopment Agreement with Niemann Holdings LLC <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the attached resolution <br /> authorizing the Mayor to execute an amendment to the redevelopment agreement with Niemann <br /> Holdings LLC for the Pines Shopping Center located in the 2200 Block of East William St. <br /> BACKGROUND: The Decatur City Council approved an agreement with Niemann Holdings LLC <br /> in November 2009 to redevelop the Pines Shopping Center area. As part of the project, Niemann has <br /> completed demolition of the old Save-A-Lot store and replaced it with a new store and accessory <br /> buildings on site. This amendment would give the company until June 30, 2012 to cause the <br /> demolition of an existing Family Dollar store building and related structures on the project site and to <br /> start construction of all remaining phases of the project. The agreement currently calls for demolition <br /> and construction of all phases to start by the earlier of(a) the expiration of leases of tenants in the <br /> existing buildings, (b) the agreement of tenants in the existing buildings on the project site to relocate <br /> or by (c) December 1, 2012, <br /> POTENTIAL OBJECTION: None. <br /> INPUT FROM OTHER SOURCES: N/A <br /> STAFF REFERENCE: Any additional questions may be forwarded to Billy Tyus at 424-2727 or at <br /> btyus@decaturil.gov. <br /> BUDGET/TIME IMPLICATIONS: N/A <br />
