1 � <br /> I <br /> AGREEMENT <br /> 1 <br /> This AGREEMENT, made by and between the City of Decatur, Illinois, an Illinois Municipal <br /> Corporation(hereinafter referred to as"City")and Pierce Manufacturing, Inc. (hereinafter referred to as <br /> I "Pierce") for the manufacture and purchase of a fire apparatus. For and in consideration of the <br /> promises and obligations made and assumed hereunder, the City and Pierce agree to the following ! <br /> mutual covenants and promises: <br /> I <br /> 1. Pierce shall furnish the apparatus and equipment according to the specifications as l <br /> specifically set forth in Exhibit A attached hereto and incorporated by reference. <br /> 2. The City agrees to accept said apparatus and equipment so long as said equipment and <br /> apparatus meets the specifications set forth in Exhibit A. <br /> I 3. Pierce agrees to deliver said equipment and apparatus to the Decatur Fire Department, 1415 <br /> I North Water Street, Decatur, Illinois no later than seventy-five (75) days after the receipt and <br /> acceptance of this Agreement. <br /> 4. Pierce agrees that all materials and workmanship of the equipment and apparatus shall <br /> comply with the specifications set forth in Exhibit A. <br /> 5. Pierce agrees and warrants the fire equipment and apparatus as set forth in Exhibit B <br /> attached hereto and incorporated by reference. <br /> I <br /> 1 <br /> 6. Pierce affirmatively represents and warrants that the fire equipment and apparatus <br /> described in Exhibit A meets and conforms with all Federal Department of Transportation rules and <br /> regulations in effect at the time of execution of this Agreement. <br /> I <br />
