City of Decatur <br /> STRAND Page 7 <br /> ASSOCIATES, INC" June 10, 2011 <br /> E N G I N E E R S <br /> Dispute Resolution <br /> Except as may be otherwise provided in this Agreement, all claims, counterclaims, <br /> disputes, and other matters in question between OWNER and ENGINEER arising out of <br /> or relating to this Agreement or the breach thereof will be decided first by mediation, if <br /> the parties mutually agree, or with a bench trial in a court of competent jurisdiction <br /> within the State of Illinois. <br /> Indemnification—Illinois Freedom of Information Act <br /> ENGINEER will comply with applicable laws, codes, and regulations in effect as of the <br /> date of this Agreement. All documents and records in the possession of ENGINEER, <br /> subconsultants, subcontractors, and any other person employed by ENGINEER, <br /> subconsultants, or subcontractors to perform a governmental function on OWNER's <br /> behalf and directly related to the governmental function are subject to the Illinois <br /> Freedom of Information Act.
