R2011-101 <br /> RESOLUTION AMENDING FLEXIBLE BENEFITS <br /> PLAN ADOPTION AGREEMENT <br /> SECTION 125 CAFETERIA PLANS <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> That Article VI Definitions 6.2(d) of the City of Decatur's Flexible Benefits Plan <br /> Adoption Agreement, approved by the City Council of the City of Decatur, Illinois, on <br /> February 17, 1992, be, and is hereby modified and amended so that, as modified and amended, <br /> said Article VI. Definitions 6.2(b) shall read as follows, effective January 1, 2011: <br /> 6.2(d) DEFINITIONS <br /> (d) "Medical Expenses" means any expense for medical care within the meaning of the term <br /> "medical care" as defined in Code Section 213(d) and as allowed under Code Section 105, <br /> Code Section 106(f), the rulings and Treasury regulations thereunder, and not otherwise used <br /> by the Participant as a deduction in determining his tax liability under the Code. However, a <br /> Participant may not be reimbursed for the cost of other health coverage such as premiums paid <br /> under plans maintained by the employer of the Participant's spouse or individual policies <br /> maintained by the Participant or his spouse or Dependent. Furthermore, a Participant may not <br /> be reimbursed for "qualified long-term care services" as defined in Code Section 770213(c). <br /> Expenses incurred for medicines or drugs may be reimbursed only if(1) the medicine or drug <br /> requires a prescription, (2) is available without a prescription (an over-the-counter medicine r <br /> drug) and the individual obtains a prescription, or(3) is insulin. <br /> PRESENTED AND ADOPTED this 20`x' day o Jun 2 <br /> W AEL T.
