Newell, Acting Public Works Direct <br /> RE: Woodford Street Sewer•and Pavement Repairs <br /> Problem Description: On March 21, 2011, a 12" water main in the 2000-block-of North <br /> Woodford Street ruptured causing significant damage to the concrete pavement and the . <br /> sewer system forcing a total closure of the road which carries approximately.3;750. .. . <br /> vehicles per day. <br /> Legal Basis for Emergency Action: This event requires immediate:-.action.to..suppress.or <br /> prevent the spread of disease or to remove imminent danger to persons or property.- <br /> Under <br /> roperty.Under the definition contained in Chapter 46, Section 1 of the Decatur Municipal Code, this <br /> event is an emergency. <br /> Pursuant to Chapter 46, Section 2 of the Decatur Municipal Code, the City Manager may <br /> declare an emergency based on the facts of the event. Under the emergency powers <br /> granted, the City Manager may utilize all available resources of the.City as are necessary <br /> to cope with the emergency including the purchase of repair services that:may exceed.. <br /> $5,000. <br /> Based on the facts of the situation, it is my opinion that an emergency exists and that the <br /> City Manager should declare an emergency so that sewer repairs and necessary <br /> pavement replacement can be contracted from a private contractor.. Based on the nature <br /> of the repair, cost of the work is expected to exceed $5,000. 1 also recommend that Barr <br /> Robison Sewer and Excavating be hired to perform the repair work with payment to-be <br /> made from the Water Fund. Barr Robison is currently under contract with the City for <br /> emergency sewer repair work. <br /> Emergency Declaration: Based on the facts of the event described in this memorandum <br /> and under the authority granted by Chapter 46 of the Decatur Municipal Code, 1 hereby <br /> declare this event to be a sanitary sewer emergency and authorize the Public Works <br /> Director to purchase repair services using City Water Funds to correct the.problem: <br /> Approved: <br /> Ryan .
