CAP-10-962-ARRA, Contract No. 4021 <br /> This Amendment No. 1 to an Agreement dated August 25, 2010, befinreen the State of Illinois, Department <br /> of Transportation, Division of Public and Intermodal Transportation and Citv of Decatur, is made and <br /> entered into by and befinreen the parties thereto. <br /> In consideration of the mutual covenants contained herein and in such Agreement, the Parties agree as <br /> follows: <br /> 1. To amend ITEM 2-THE PROJECT by deleting it in its entirety and inserting in lieu thereof: <br /> The Grantee agrees to undertake and complete the Project and to provide for the use of Project <br /> Equipment and Facilities, in the manner set forth in the Grantee's final application that has been <br /> approved by the Department, for the amounts set forth in the Approved Project Budget, a copy of <br /> which is attached hereto and incorporated herein as Exhibit"B", and in accordance with the <br /> requirements of this Agreement and all applicable laws and regulations. The Project, which is more <br /> particularly described in the plans, specifications and schedules set forth in the Grantee's final <br /> approved application, is generally described as follows: <br /> 2. To amend "ITEM 3—Amount of GranY' by deleting paragraph one in its entirety and inserting in <br /> lieu thereof: <br /> The estimated Net Project Cost is$116,215.03. The Department agrees to make a grant <br /> reimbursing the Grantee in an amount equal to 100 percent of the actual Net Project Cost, as <br /> determined by the Department upon completion of the Project, in an amount not to exceed <br /> $116,215.03. However, the Department(at its sole discretion) may agree to increase the <br /> amount of the Grant in excess of the amount specified herein but in no event shall the total <br /> amount provided by the Department under this Agreement or any subsequent Amendment to <br /> this Agreement exceed 100 percent of the actual Net Project Cost. The Project will be funded <br /> with 100%federal funds. <br /> a. The following items will be funded by this Grant at a rate of 100% of actual net project costs in <br /> federal ARRA TIGGER funds and 0% in state funds. <br /> 1-(one)-Hybrid Startrans, 12 Passenger Paratransit Vehicle <br /> with lift and Selected Options not to exceed $113,729.03 <br /> b. The following items will be funded by this Grant at a rate of 100% of actual net project costs in <br /> federal funds and 0% in state funds: <br /> Azure Dynamics Hybrid Diagnostic Testing Kit not to exceed <br /> $2,486.00 <br /> 3. To amend the"Mass Transportation Capital Grant AgreemenY' by deleting the Agreement dated <br /> Auqust 25, 2010, in its entirety and replacing it with the attached agreement(REV: 10/20/10)along <br /> with its Appendices executed on the date below. <br /> This Contract No. 4021 (hereinafter referred to as"Agreement") is made by and between the Illinois <br /> Department of Transportation, Division of Public and Intermodal Transportation, (hereinafter referred to <br /> as the"State"or"Department") and the City of Decatur, (hereinafter referred to as the "Grantee,"which <br /> term shall include its successors and assigns). <br /> State/Federa!Capita!Grant Page 4 <br />
