� <br /> . /'�s���!� " �°�� <br /> EXHIBIT B <br /> LEASE <br /> THIS LEASE, made and entered into by and between the CITY OF DECATUR, <br /> ILLINOIS, a municipal corporation (hereinafter referred to as "CITY"), and Nick G. Striglos, <br /> (hereinafter referred to as "STRIGLOS"). <br /> WITNESSETH: <br /> 1. Premises. The CITY does hereby demise and lease to STRIGLOS the following <br /> described premises: <br /> a. Up to twelve (12) spaces (for weekdays between the hours of 9:00 a.m. and 4:30 <br /> p.m.) in the City's parking area of the parking lot as shown on EXHIBIT A. <br /> 2. Exclusive Use. During the term of this Lease, STRIGLOS shall enjoy exclusive use <br /> and possession of all said parking spots from 9:00 a.m. to 4:30 p.m. Monday through <br /> Friday. <br /> 3. Term. The term of this Lease shall commence on and shall terminate twenty (20) <br /> years from the date of commencement with a renewal option of another twenty (20) <br /> years, except as may be earlier terminated by the provisions of this Lease. Such <br /> option may be exercised by written notice by STRIGLOS to CITY at any time prior to <br /> the expiration of the initial twenty (20) year term. <br /> 4. Rent. STRIGLOS shall not be required to pay to the CITY, any rent for the above- <br /> described premises. <br /> 5. Taxes. STRIGLOS shall pay their pro rata share of taxes, if any, due on the above- <br /> described premises which are attributable to STRIGLOS's Lease or use of the <br /> premises. <br /> 6. Compliance with Laws. STRIGLOS agrees to observe and comply with alt rules, <br /> regulations, ordinances, statutes and zoning laws now in force or which may be <br /> enacted during the continuation of this Lease by the CITY or any other Municipal, <br /> County, State or Federal authority and to indemnify the CITY for any damage caused <br /> by violation thereof. <br /> 7. Release. STRIGLOS, in using the premises, does so at its own risk. The CITY shall <br /> not be liable for any damages to property sustained by STRIGLOS on the premises, <br /> or any portion thereof, except as resulting from the CITY's violation of any term of this <br /> Lease. Except as resulting from the CITY's violation of any term of this Lease, <br /> STRIGLOS assumes full responsibility for property damages or injuries which may <br /> occur to STRIGLOS or its officers, employees, directors, agents or contractors, <br /> resulting from or arising out of STRIGLOS's use of the premises. STRIGLOS does <br /> hereby fully and forever on its own behalf release and discharge the CITY and the <br /> CITY Council members, CITY employees, officers, invitees and agents, in both <br /> individual and official capacities, from any and all claims, demands, damages, rights <br /> of action, present or future, whether the same be known, anticipated or unanticipated, <br /> whether due to negligence or otherwise, resulting from or arising out of STRIGLOS's <br /> use of the premises, except as resulting from the CITY's violation of any term of this <br /> Lease. <br />
