��. . <br /> �t <br /> � <br /> �� <br /> Exhibit E <br /> a, <br /> m <br /> � <br /> iy <br /> � <br /> '� <br /> � <br /> �' AMENDMENT TO LEASE <br /> � <br /> � <br /> 0 <br /> 0 <br /> ��+ THIS AMENDMENT TO THE LEASE dated , 2010, is made and <br /> entered into by and between the CITY OF DECATUR, ILLINOIS, a municipal corporation <br /> (hereinafter referred to as "City"), and ARCHER- DANIELS-MIDLAND COMPANY, a Delaware <br /> corporation licensed to conduct business in the State of Illinois, (hereinafter referred to as <br /> "ADM"). <br /> WHEREAS, the parties have entered a Lease dated , 2010, and <br /> now desire and intend to amend the Lease as set forth below; <br /> WHEREAS, in consideration of the promises and mutual covenants contained herein, <br /> and other good and valuable consideration, the parties hereby agree as follows: <br /> WITNESSETH: <br /> 1. Premises. Effective the date of this Amendment, the City does hereby demise and <br /> lease to ADM the following described premises: <br /> a. All Parking Spaces in Parking Garage B located at the northwest corner of Water <br /> and North Streets, City of Decatur, Illinois totaling approximately 657 spaces. <br /> b. Within thirty (30) days of the date of this Amendment, the City shall have <br /> terminated the lease or use rights of any third party to use or access the Parking <br /> Spaces in Parking Garage B, except the right of Regions Bank (as sublessee of <br /> ADM) to use 70 parking spaces at Parking Garage B, and except the right of <br /> Reynolds Development Company to use 20 parking spaces at Parking Garage B. <br /> 2. Exclusive Use. During the term of this Lease, ADM shall enjoy exclusive use and <br /> possession of the Parking Spaces (except the right of Regions Bank to use 70 <br /> parking spaces and the right of Reynolds Development to use 20 spaces as <br /> referenced at paragraph 1 b. above) during 6:00 a.m. to 5:00 p.m. Monday through <br /> Friday. During all other periods, ADM's use and possession rights shall be non- <br /> exclusive. <br />
