,.. , <br /> RELEASE AND GRANT OF EASEMENT <br /> THIS RELEASE AND GRANT OF EASEMENT is entered this ��.day of lU��r.e,n,,�ra.er , <br /> 2010, by and between the City of Decatur ("City") and Archer-Daniels-Midland Company <br /> ("ADM"). <br /> WHEREFORE, ADM has entered into a contract with Reynolds Development LLC to purchase <br /> the real estate commonly known as 350 North Water Street, Decatur, Illinois, and as described <br /> by the attached Exhibit A; <br /> WHEREAS, the City has an interest in ADM acquiring the Property and desires to assist in the <br /> transfer of clear title; <br /> WHEREFORE, the parties agree, in exchange for mutual covenants contained herein and other <br /> good and valuable consideration, agree and contract as follows: <br /> 1. The City releases any rights and claims against the Property arising from or related to <br /> the encroachment of the building upon property adjoining on the north and west, as <br /> shown on the Plat of Survey dated August 17, 2010, by Robert M. Dean, Jr., Illinois <br /> Professional Land Surveyor No. 2951. <br /> 2. The City releases any rights and claims against the Property arising from or related to <br /> the encroachment of overhanging canopies upon the Property adjoining on the west and <br /> south as shown in the Plat of Survey dated August 17, 2010 by Robert M. Dean, Jr., <br /> Illinois Professional Land Surveyor No. 2951. <br /> 3. The City releases any rights and claims against the Property arising from or related to <br /> the encroachment of telephone splice box, concrete, signs, lights and landscaping upon <br /> the Property adjoining on the east, as shown on the Plat of Survey dated August 17, <br /> 2010, by Robert M. Dean, Jr., Illinois Professional Land Surveyor No. 2951. <br /> 4.
