E., Director of Public Works SUBJECT: Water Service Agreement for 3032 North Westlawn Avenue SUMMARY RECOMMENDATION: It is recommended by staff that the City Council approve the attached resolution authorizing a Water Service Agreement between the City of Decatur and the property owner of 3032 North Westlawn Avenue. PRIOR COUNCIL ACTION: There have been no prior Council actions regarding providing water service to 3032 North Westlawn Avenue. In accordance with the City Code 64-12, water may be furnished to properties outside the City limits only through an agreement with the City Council. March 25, 2010 - Council approved Ordinance 2010-16 authorizing a Water Service Agreement with the property adjacent to and east of 3032 North Westlawn Avenue, at. 2110 West Pershing Road. BACKGROUND: In 1990 a 12-inch ductile iron water main was extended south of North Westlawn Avenue to West Pershing Road to service residents south of the Boiling Springs area and provide for a future distribution loop connection to North Summit Avenue. As at other locations along the perimeter of the city, property owners along water lines that extend beyond the City limits and are outside of an existing Water Agreement District request permission to connect to City water. As required by City Code, these properties must enter into a Water Service Agreement with the City. The Water Service Agreement includes a requirement that the property owner petition the City for annexation when the property becomes contiguous to the corporate limits. POTENTIAL OBJECTIONS: There are no known objections to this resolution and agreement. Page � 1
