7. Indemni�cation. Developer shall indemnify and hold harmless the City <br /> and its City Council members, officers, employees or agents in both <br /> individual and official capacities (the "City Indemnitees"), from all claims <br /> for bodily injury, death or property damage resulting from or axising out of <br /> Developer's use of the premises, and from all costs, demands, suits, losses, <br /> attorney's fees and liabilities incurred in or about any such claims for <br /> bodily injury, death or property damage, or any action or proceeding <br /> brought thereon. Notwithstanding the foregoing, the provisions of this <br /> Section 7 shall not require Developer to indemnify the City Indemnitees <br /> with respect to any loss, damage, claim, demand, action or injury resulting <br /> from the gross negligence or willful act of the City or its employees, <br /> agents or assigns. <br /> 8. Insurance Requirements. Developer shall obtain at i�s expense, and <br /> keep in force during the term of this Lease, comprehensive general <br /> liability and property damage insurance in an amount of not less than <br /> $1,000,000 single limit, $2,000,000 aggregate, for bodily injury, death and <br /> property damage to any one person and subject to the same limitations for <br /> any one occurrence. The comprehensive general liability policy shall <br /> include coverage for premises and operations, a blanket contractual <br /> liability coverage which includes the indemnification agreement contained <br /> in the next proceeding paragraph, broad form property damage, <br /> independent contractors and personal injury liability coverage. The policy <br /> or policies issued for the above-described coverage shall name the City as <br /> an additional insured. Such insurance shall not be cancelled prior to the <br /> termination of this agreement. <br /> 9. Certi�cate of Insurance. Prior to the commencement of the terms of the <br /> Lease, Developer shall file with the City, and at all times thereafter during <br /> the term of this Lease keep in full force and effect, a Certificate of <br /> Insurance, in a form acceptable to the City Risk Manager, signed by an <br /> authorized agent of the insurance company or companies writing the <br /> insurance described in said Certificate showing complete coverage of all <br /> insurance required in this Lease. Such Certificate shall certify to the <br /> following: <br /> a. Name and address of party insured; <br /> b. Name(s) of the insurance company or companies; <br /> c. Name and address of the authorized agent executing such <br /> Certificate; <br /> d. The description of the type of the insurance and the coverage <br /> afforded thereunder; <br /> e.
