E., Director of Public Works � ��` SUBJECT: Water Service Agreement for 5330 Rea's Bridge Road SUMMARY RECOMMENDATION: It is recommended by staff that the City Council approve the attached resolution authorizing a Water Service Agreement between the City of Decatur and the property owner of 5330 Rea's Bridge Road. PRIOR COUNCIL ACTION: There have been no prior Council actions regarding providing water service to 5330 Rea's Bridge Road. In accordance with the City Code 64-12, water may be furnished to properties outside the City limits only through an agreement with the City Council. BACKGROUND: In 1998, a 12 inch water main was extended along Rea's Bridge Road as part of the sale of the North Water Treatment Plant to Archer Daniels Midland, Inc. This allowed the City to abandon a large 30 inch main that connected the plant to the city's water system. As at other locations along the perimeter of the city, property owners along water lines that extend beyond the City limits, request permission to connect to City water. As required by City Code, these properties must enter into a Water Service Agreement with the City. The Water Service Agreement includes a requirement that the property owner petition the City for annexation when the property becomes contiguous to City limits. City staff approved the water service connection for 5330 Rea's Bridge Road prior to Council action due to the failure of the well serving the property. This was deemed an emergency that constituted a public health hazard for the property. POTENTIAL OBJECTIONS: There are no known objections to this resolution and , agreement.
