WHEREAS,pursuant to Article VII, section l 0 of the 1970 Constitution of the State of Illinois, and the Illinois Intergovernmental Cooperation Act (SILCS 220/l et seq- 1992),units of local government in the State of Illinois may contract between themselves to obtain or share services and to exercise or combine functions which either-of the units of local government are authorized by law to perform;and, WHEREAS,the CITY agrees that the construction, operation and maintenance of the K-MART Pump Station is the responsibility of the CITY,and the DISTRICT operates and maintains the pump station per agreement with the CITY, WHEREAS,the CITY and DISTRICT agree that the existing K-Mart Pump Station needs of to be replaced to adequately serve the properties connected to this pump station, WHEREAS,the CIT'I'requests the DISTRICT manage a construction project to replace the K- MART Pump Station and decommission the existing K-MART Pump station. NOW,THEREFORE, in consideration of the mutual covenant herein contained, the parties agree as follows: 1. ENUMERATION OF ATTACHMENTS The exhibits attached hereto and listed below are made a part of this Agreement. Exhibit'A'-Letter of Direction from the City of Decatur Exhibit'B'—Agreement for design en�ineering services for New K-MART Pump Station Exhibit'C'—Agreement for construction engineering services for New K-MART I'ump Station Exhibit'D'—Contractor Insurance Requirement schedule for construction of the New K-MART Pump Station � The CITY acknowledges and agrees that it has thoroughly reviewed exhibits A through D, and further states that by execution of this agreement all of the terms, conditions, obligations, designs,and services set forth in exhibits A through D are acceptable to the CI"TY. 2. EASEMENTS AND RIGHTS OF WAY The CITY agrees to pay all costs to obtain title and/or access to thc properties rec�uired for•completion of this project. Additionally,the CITY grants to the DISTRICT any and al] authority vested in the CITY to complete this projecl. AGREE - 1
