c ' <br /> INTERGOVERNMENTAL AGREEMENT <br /> This AGREEMENT, made by and between the City of Decatur, Illinois, ("City"), a <br /> municipal corporation, and the Decatur Park District ("District"), a unit of local <br /> government, is for the purpose of setting forth the rights and responsibilities of the <br /> construction and maintenance of an eight (8) inch ductile iron water main and <br /> appurtenances to replace an existing six (6) inch water main to provide Aircraft Rescue <br /> and Fire Fighting ("ARFF") water and potable water to and on property owned, <br /> operated and maintained by the District, commonly referred to as the Decatur Airport <br /> ("Project"). <br /> WHEREAS, the City and the District are units of local government as defined by <br /> Article VII, Section 1 of the Constitution of the State of Illinois ("Constitution"); and, <br /> WHEREAS, the City and the District are authorized and empowered by Article <br /> VII, Section 10 of the Constitution to enter into intergovernmental agreements; and, <br /> WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et. seq., <br /> provides that any power or powers, privileges or authority exercised or which may be <br /> exercised by a unit of local government may be exercised and enjoyed jointly with any <br /> other unit of local government; and, <br /> WHEREAS, the City and the District agree that it would be in their best interests, <br /> as well as the public interest, that the Project proceed in accordance with the terms and <br /> conditions set forth below. <br /> NOW THEREFORE, for and in consideration of the promises and covenants <br /> made herein, the City and the District agree as follows: <br /> 1. That the District shall construct, improve or cause to be constructed or improved, an <br /> eight (8) inch ductile iron water main and appurtenances to replace an existing six (6) <br /> inch water main on property owned, operated and maintained by the District commonly <br /> referred to as the Decatur Airport. <br /> 2. That the Project includes plans to cover a significant portion of the eight (8) inch <br /> water main and appurtenances with ten (10) inches of concrete pavement. <br /> 1 <br />
