Amendment No. 3 to Agreement C08L0198 Whereas, the City of Decatur, subsequently referred to as "Client,"and Hanson Professional Services Inc., subsequently referred to as "Hanson,"have previously entered into a Professional Services Agreement dated December 29, 2008 in connection with the Lake Decatur Dam Repairs subsequently referred to as "Project,"and Whereas, the Client has ordered certain changes to the services being provided by Hanson for the Project. Now,therefore, this Amendment to the Agreement(Amendment No. 3) is made this 17th day of September, 2009 to revise the Scope of Services and Cost of Services as provided herein. All other terms and conditions of the Agreement remain unchanged. The Scope of Services is modified as follows: l. Annual Escalation of Rates: a. Contract Amendment No. 2 is for construction services which were planned for 2009. Due to the lack of bids during the initial advertisement period, these services were postponed. The project will be re-bid in January 2010, with construction anticipated for that year. Therefore the amount of compensation for construction services in Amendment No. 2 is increased to account for the anticipated escalation of wage rate schedules. b. The 2010 wage rate schedules have not been finalized at this time. A 2010 wage rate schedule for Hanson, and our subconsultants, will be provided to the City when it becomes available. 2. Hydraulic Cylinder Installation: a. It is our understanding that the City of Decatur will procure a total of eight hydraulic cylinders designed to replace the existing cylinders which operate the two bascule gates on the dam. The following additional services will be provided related to the cylinder installation: i. Review of Contractor's submittals. ii. Telephone and written correspondence to support response to Contractor's Request for Information(RFI) during fabrication, testing and installation. iii. Pre-production meetings and manufacturer's shop visits to observe hydraulic cylinder testing required by the specifications. iv. Field observations during installation and functional testing of the hydraulic cylinders. 3. Revise Plans, Specifications and Estimates: a. In order to prepare bidding documents to reflect the scope of work for cylinder installation and revised bidding information, the following additional services will be provided: i. Revise bidding documents to reflect the change in bid dates. ii. Review status of existing environmental permits. iii.
