✓ <br /> � � <br /> INTERGOVERNMENTAL AGREEMENT <br /> BETWEEN THE SANITARY DISTRICT OF DECATUR, A MUNICIPAL CORPORATION, <br /> AND THE CITY OF DECATUR. A HOME RULE MUNICIPAL CORPORATION, BOTH OF <br /> MACON COUNTY, ILLINOIS, FOR THE MAINTENANCE OF CERTAIN CITY OF <br /> DECATUR PUMP STATIONS <br /> THIS AGREEMENT effective the lst day of May, 2009, between the Sanitary District of <br /> Decatur, a Municipal Corporation, Macon County, Illinois ("DISTRICT") and the City of <br /> Decatur, a home rule Municipal Corporation, Macon County, Illinois ("CITY"). <br /> WHEREAS, pursuant to Article VII, Section X of the 1970 Constitution of the State of <br /> Illinois, and the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.), units of local <br /> government in the State of Illinois may contract between themselves to obtain or share services <br /> and to exercise or combine functions which either units of the local government is authorized by <br /> law to perform; and, <br /> WHEREAS, the CITY agrees that the operation and maintenance of certain pump <br /> stations is necessary for the transportation of wastewater in the City of Decatur; and <br /> WHEREAS, the DISTRICT concurs that the effective maintenance and servicing of <br /> CITY owned pump stations is necessary to maintain the flow of wastewater to the Sanitary <br /> District of Decatur Treatment Plant; and <br /> WHEREAS, the CITY requests the DISTRICT to maintain certain CITY owned <br /> wastewater pump stations. <br /> NOW, THEREFORE, for and in consideration of the mutual covenants contained, the <br /> parties agree as follows: <br />
