g. The ENGINEER warrants that no person or selling agency has been employed or <br /> retained to solicit or secure this contract upon an agreement or understanding for a <br /> commission, percentage, brokerage, or contingent fee, excepting bonafide <br /> employees. For breach or violation of this warranty, the OWNER shall have the <br /> right to annul this AGREEMENT without liability or in its discretion to deduct from <br /> the contract price or consideration or otherwise recover, the full amount of such <br /> commission, percentage, brokerage or contingent fee. <br /> h. The ENGINEER certifies that the services of anyone that has been debarred or <br /> suspended under federal Executive Order 12549 has not or will not be used for <br /> planning, design and construction. <br /> 4. Insurance ReQuirements <br /> The ENGINEER shall procure and maintain, at its expense, insurance of the types and in <br /> the minimum amounts stated below: <br /> a. Workman's Compensation Insurance in full compliance with the Workman's <br /> Compensation Act and Employers Liability coverage of not less than as defined by <br /> Illinois State Statutes. <br /> b. Comprehensive General Liability <br /> Bodily Injury $250,000/500,000 each occurrence <br /> Property Damage $250,000 each occurrence or <br /> $500,000 Single Limit Liability <br /> c. Comprehensive Automobile Liability <br /> Bodily Injury $250,000 single per occurrence <br /> Including Death $500,000 two or more, per occurrence <br /> Property Damage $100,000 each occunence <br /> d. Architects & Engineers <br /> Professional Liability $1,000,000 <br /> e. Umbrella over above <br /> Items b and c $1,000,000 <br /> The Comprehensive General Liability policy shall include blanket contractual liability <br /> coverage or a contractual liability endorsement covering the liability assumed by the <br /> ENGINEER under this AGREEMENT, with limits not less than those specified herein. <br /> Certificates furnished hereunder shall reflect such coverage. <br /> Insurance shall be written by a company or companies satisfactory to the OWNER. Before <br /> commencing any work hereunder, a certificate evidencing that maintenance of said <br /> BGM 04-l 00C Page 4 <br />
