• The Evaluation Committee's scoring sheet, which gives the Committee's average <br /> score for each of the seven evaluation criteria listed in the RFP. <br /> During the Council meeting, both firms were given the opportunity to present their qualifications <br /> without time limitation. The Council also listened to a presentation from the Amalgamated <br /> Transit Union on their opinion of the qualifications of both firms. The Council then had an <br /> opportunity to ask questions of the two firms, and to question the three members of the <br /> Evaluation Committee about why each member favored one firm over the other. <br /> You will note that Section 13 Propose�•Evaluation and Selection Process of the RFP ends with <br /> the following sentence: <br /> "The firm receiving the most points will be recommended by the Committee <br /> to the City Council, whose decision shall be final." <br /> Clearly the City Council has the final authority to accept or to reject the recommendation of the <br /> Evaluation Committee. In this case after lengthy discussion and consideration of all of the <br /> evaluation criteria, the City Council voted to award the management contract to a firm that was <br /> not recommended by the Committee. <br />' Based on our review of pertinent information related to this procurement process and the <br /> procedures utilized in this contract award, the City of Decatur makes the following <br /> determinations: <br /> 1) The City's selection process guaranteed full and open competition among all <br /> proposers; <br /> 2) The City of Decatur followed the selection procedures specified in the RFP; <br /> 3) The Decatur City Council did not ask First Transit to modify their proposal, and the <br /> Council did not amend the contract; <br /> 4) The City's decision to award the management contract to First Transit, Inc. was based <br /> on the full and open discussion of all factors and was not an arbitrary decision; and <br /> 5) The Decatur City Council awarded the contract to the responsible firm whose <br /> proposal was determined to be most advantageous to the City's transit system, with <br /> price and other evaluation factors considered, as defined in the Request for Proposals. <br />' Therefore, the Decatur City Council finds that the arguments and assertions contained in your <br /> Post-Award Protest letter are without merit. <br /> Si cere , � <br /> / <br /> Michael T.
