Name of Employer <br /> RETIREE WELFARE BENEFITS PIAN <br /> ARTICLE I <br /> Preamble <br /> �1 H1S 1N�'I��RUMENT made and published l�y City of Decatur,Iliinois (hereinafter called "T�mployer")on <br /> che 15 �ay�f_lune ___ Z��O9 ,creares the City o Decatur Keriree Welfare I3enefits <br /> Plan,as follo�vs: <br /> 1.01 Establishment of Plan <br /> The Employer named above llereby establishes a R�riree Welfare Senefirs Plan as of the 1S� day of lune 2� 09 <br /> 1.02 Purpose of Plan <br /> This Plan has been established to reimburse the eli�ible Rerirees of�he Gmployer for m�dical and dental expenses incurred by <br /> them, their Spouses and I�e��c°ndenrs pursuant to the E?mployer's Vanta};eCare Retirement Healrh Savings (RHS) Plan. <br /> ARTICLE II <br /> Definitions <br /> The following words and phrases as used herein shall have dle following meanings,unless a different rneaning is plainly <br /> required by the co�text: <br /> 2.01 "Benefits" means any amounts paid to a Participant,Spouse or Dependents in the Plan as reimbursemen�for Eligible� <br /> Medical and Dental F,xpenses incurred by the Participan�during a Plan Year bv him, his Spouse or his Dependents. <br /> 2.�2 "Code" means the Incernal Revenue Code of 1986,as amended. <br /> 2.03 "Dependent" means any individual who is a dependent of the Parcicipant within the meaning of Code Sec. 152,as <br /> ain�lified by Internal Revenue Service Notice 2004-79,2004-49 I.R.f3.898. <br /> 2.04 "Eligible Medieal Expenses" iTieans those expenses ciesignaced hy�he Employer as eligible for reirnbursement in <br /> the VantageCare Retirement Health Savings I'lan Adoption Agreement. <br /> 2.�5 "Emp�oyer" means the unit of scate or local government creating this Plan, nr any affiliate or s�iccessor there�if chat <br /> likewise adop�s this Plan. <br /> 2.�6 "Entry �qte" mcans�hc hrsc day rhe I'articiE�ant mec�s the eligibiliry rcyuiremencs of Article III as oFsuch l.>ate. <br /> 2.�7 "PartiCipant" means any Retir�e who has met the eligibiliry requirements se�forth in Ar�ticle (II. <br /> 2.08 "P�qn Administrator" means rhe L mploye�r or other person appoinred by che Gmployer who has the authoriry and <br /> res�,�onsil�iliry to manage and direci the oEaer.�tion and adminisrrarion of rhe T'lan. <br /> 2.�9 "P�an Yeqr" means�he an�ual accounti�g��eriod of the Plan,which begins on the �S`" day of i,�„P <br /> _,20 09 , and ends on the 31st day of December ,20 �9 ,with respect to che first Plan Year,and <br /> thereafter as long as this Plan remains in eFfect�> the period tliat begins o❑ lanuary 1 ,and ends on mc�nth/day <br /> December 31 <br /> � <br /> ���� <br /> ����� � � � � <br /> ,.�.:� <br />
