Excerpts from Plan Commission Minutes of February 5, 2009 continued: <br /> common sense can be used to eliminate the hardship that the petitioners are facing by moving <br /> this case forward and rezone to R-5. <br /> Mr. James Watson was sworn in by Mrs. Poland. <br /> Mr. Watson has lived at #6 Edgewood Court since 1979. Mr. Watson knew the previous owners <br /> and has been inside the property many times. Mr. Watson stated he is in possession of a petition <br /> that has many signatures of people that live on Edgewood Court and Victoria Lane. <br /> Mr. Watson said the rear of this property is on Victoria which is a dead end street which backs <br /> up to the ravine that separates Fairview Park from the West End area. The front of the property <br /> sits on Edgewood Court. The traffic on these streets is limited. <br /> Mr. Watson stated the duplexes that Mr. Flynn spoke of earlier being a few houses away from#5 <br /> Edgewood Court are not on Edgewood or Victoria. There is a duplex that faces West Main <br /> Street with one unit of the duplex facing Edgewood Court. The nature of the neighborhood is <br /> distinctly different than the nature of the streets where the other apartments or multi-family <br /> residences are located. Mr. Watson feels rezoning this property is not to the advantage of the <br /> families living on these streets since it is likely to increase the number of residents on the street <br />, which will cause difficulty in parking and additional traffic on the street. <br /> Mr. Watson said the property has not been used as a duplex for thirty (30) years. The property <br /> was not restructured during this time. The upper level was used for storage. <br /> Mr. Watson stated this is a small neighborhood where the children are able to play freely without <br /> a lot of traffic. The homes are all single family homes. Mr. Watson said if this was to be <br /> rezoned it would not change the nature of the West End but it would make a difference in the <br /> immediate area of Edgewood Court and Victoria. The property was rented as a duplex over the <br /> si.umner and nine (9)people were living in the residence. <br /> Mr. Mickler asked if Mr. Watson said the home had not been used as a duplex since 1979. Mr. <br /> Watson stated this last suinmer the petitioners had rented the home as a duplex. <br /> Ms. Stephanie Fitzpatrick was sworn in by Ms. Poland. <br /> Ms. Fitzpatrick has resided at 222 Victoria since 1995. Ms. Fitzpatrick said one of the issues <br /> they have on Victoria is traffic getting through on the narrow road. There were many cars <br /> parked on the road while the duplex was being rented this past suimner. The garbage haulers are <br /> not able to get through at times. One of the elderly neighbors is concerned that if an emergency <br /> vehicle is needed it might not be able to get through. <br /> Mr. Tom Kotal was sworn in by Mrs. Poland. <br /> Mr. Kotal has lived at #14 Edgewood Court since 1987. The duplex that is on Main Street has <br /> one apartment that faces Edgewood Court. The owner of the duplex lived there and he was very <br /> careful who he rented the additional unit to. There were not any problems at that time. That <br /> owner sold the duplex. Presently one unit is rented to students and three gentlemen are in the <br /> other unit. These vehicles all have to park on Edgewood since parking is not allowed on Main <br /> Street. If the zoning is changed Mr. Kotal asks that some type of change be made to minimize <br /> the number of vehicles or have additional parking. <br />
