5 � <br /> City's request for payment. If payment is not remitted within thirty (30) days of the <br /> request, the City shall have the right to all remedies at law and equity as well as the <br /> right to place a lien on the property for the amount owed. <br /> 10. To the extent permitted by law, the Owner/Operator agrees to indemnify, <br /> hold harmless and defend the City, its officials, employees, officers and agents from <br /> any and all claims, demands, liability, losses, suits in law or equity arising over the <br /> construction, use, operation and maintenance of the water mains and <br /> appurtenances of the Project at the Site. <br /> 11. The Owner/Operator agrees to observe and comply with all rules, <br /> regulations, ordinances, statutes and zoning laws not in force or which may be <br /> enacted during the term of this Agreement, including but not limited to the <br /> Prevailin Wa e Act and other wa e and emplo ment laws, and further agrees to <br /> 9 9 9 Y <br /> hold harmless, indemnify and defend the City for any damage or claim caused by <br /> violation thereof. <br /> 12. That this Agreement shall be binding upon and inure to the benefit of <br /> any successor entities, parties or subsequent purchasers which shall assume the <br /> obligations of the party hereto. <br /> 13. That the City shall, after inspecting all work performed on the water <br /> mains and appurtenances of the Project at the Site and approving all work <br /> performed, accept in writing ownership of the water mains and appurtenances of <br /> i and rovide such to Owner/O erator within thirt 30 da s of <br /> the Pro�ect at the S te p p y ( ) y <br /> said approval. <br /> 14. The Owner/Operator agrees to execute, record and deliver to the City, <br />� an easement granting the City the right to perform any and all necessary work to <br /> maintain the water mains and appurtenances of the Project at the Site within thirty <br /> (30) days after completion of the Project and acceptance of ownership by the City. <br /> The City shall not be responsible for restoring, repairing or making any <br /> improvements to those improvements set forth in paragraph 2 of this Agreement. <br />' 15. This Agreement, including Exhibits, addendums and amendments, shall <br /> run with the land and be binding upon as assigns and successors in interest to the <br /> Owner/Operator of the Site. The Owner/Operator shall cause copies of this <br />' Agreement to be recorded in the office of the Macon County Recorder of Deeds in <br /> the chain of title for the Site within thirty (30) days of execution. <br /> 16. Should the Owner/Operator terminate this Agreement for any reason, it <br /> shall be responsible for reimbursing to the City the costs expended by the City in <br />
