1, � <br /> , <br /> LEGALDEPARTMENT MEMORANDUM I <br /> NO. 2009-02 <br /> February 12, 2009 <br /> TO: Honorable Mayor Carrigan and City Council <br /> FROM: Ryan McCrady, City Manager ��� <br /> Wendy Morthland, Corporation Counsel ���� <br /> Ron Neufeid, Director of Financial Managemen <br /> Amy Waks, Assistant Corporation Counsel <br /> SUBJECT: Amendment to Chapters 15 (Legal Department), 18 (Finance <br /> Department), and Chapter 34 (Traffic) <br /> SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed <br /> ordinance amendments regarding Chapters 15, 18, and 34 to allow for the costs of the <br /> use of outside collection methods be charged to the offender who owes the debt. <br /> BACKGROUND: The City of Decatur on occasion uses the service of outside collection <br /> methods in order to collect on debts due to the City via unpaid fines such as parking and <br /> traffic citations, animal control citations, fire citations, etc. The State has enacted a <br /> statute which allows municipalities to charge the debtor the cost incurred in the process <br /> of collection. <br /> RECOMMENDATION: Staff recommends that Council pass the proposed amendments <br /> in order to add the cost of collection to the amount owed to the City by the debtor. <br /> POTENTIAL OBJECTIONS: There are no known or expected objections. <br /> INPUT FROM OTHER SOURCES: <br /> STAFF REFERENCE: <br /> Amy Waks, AssistanY Corporation Counsel, at 424-2807. <br /> BUDGET/TIME IMPLICATIONS: <br />
