. � ' ' ' <br /> ORDINANCE NO. 2009-06 <br /> AN ORDINANCE REZONING PROPERTY <br /> - MUELLER HEIGHTS ADDITION - <br /> WHEREAS, on the Sth day of February, 2009, upon due notice, the Decatur City <br /> Plan Commission held a public hearing upon the petition of John Scot Mueller to rezone <br /> premises legally described as: <br /> Lots 1-19 of Mueller Heights Addition as per Plat recorded in Book 1832, <br /> Page 940 of the Records in the Recorder's Office, Macon County, Illinois, <br /> from R-3 Single Family Residence District to PD Planned Development District; and, <br /> WHEREAS, the Decatur City Plan Commission recommended that the prayer of <br /> said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City Plan Commission be, <br /> and the same is hereby, received, placed on file and approved. <br /> Section 2. That upon compliance with the condition set forth below and in the <br /> site plan attached hereto and hereby made a part hereof as Exhibit A, said above <br /> described premises be, and they are hereby, rezoned from R-3 Single Family Residence <br /> District to PD Planned Development District. <br /> A. Final plat, site plans and construction plans shall be submitted to and <br /> approved by the Economic and Urban Development Department and the <br /> Department of Engineering and Infrastructure prior to the issuance of a <br /> building permit. <br />
