<br /> EMPLOYMENT AGREEMENT
<br /> THIS EMPLOYMENT AGREEMENT(the"Agreement")is entered into by and between
<br /> the City of Decatur, an Illinois municipal corporation (the "City"), and Ryan P. McCrady, an
<br /> individual residing (or to reside) in the City of Decatur, County of M�con, State of Illinois (the
<br /> "Employee"), on this 6th day of October 2008. i
<br /> I. DEFINITIONS. ,
<br /> A. "Agreement," as used herein, shall mean the present Employment Agreement,
<br /> together with any exhibits or schedules attached hereto,made a part hereof and incorporated herein
<br /> for all purposes by express reference, and any and all amendments hereto made in accordance with
<br /> the express provisions hereof.
<br /> B. "Circuit Court," as used herein, shall mean the Circuit Court of the Sixth Judicial
<br /> Circuit, Macon County, Illinois (or any successor adjudicative body thereto).
<br /> C. "City," as used herein, shall mean the City of Decatur, an Illinois municipal
<br /> corporation with home rule powers.
<br /> D. "City Manager," as used herein, shall mean the office ofl�the administrative head of
<br /> the municipal government of the City (as defined herein) as set forth a d described within § 5-3-7
<br /> of the Code (as defined herein) (65 ILCS 5/5-3-7 (2008)), as the same ay be amended from time
<br /> to time. ,
<br /> E. "Code," as used herein, shall mean the Illinois Municip�al Code, 65 ILCS 5/1-1-1
<br /> (2008), as the same may be amended from time to time hereafter.
<br /> F. "Council,"as used herein,shall mean the body of properly elected and lawfully sitting
<br /> members of the governing body of the City(as defined herein)and as described within the Code(as
<br /> defined herein).
<br /> G. "Effective Date,"as used herein,shall mean the date upon which the City(as defined
<br /> herein),executes the Agreement(as defined herein),following the approval hereof and authorization
<br /> provided by the Council (as defined herein) at a lawfully constituted meeting thereof, and upon
<br /> execution hereof by the City (as defined herein), the authorized representative thereof shall insert
<br /> into the opening paragraph hereof said date of execution.
<br /> H. "Employee,"as used herein,shall mean Ryan P. McCrad ,an individual residing in,
<br /> or expected to reside in, the City of Decatur, County of Macon, State of�Illinois, and a party to this
<br /> Agreement(as defined herein). I
