Stickle, Senior Planner�;,4,t5 <br /> SUBJECT: Amendments to City Code Chapter 41, Section 13 (B)(5) '� <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the amendments to the Decatur City II <br /> Code as proposed. <br /> Staff recommends allowing food and beverage cart vendors to operate on a longer season like that of the <br /> temparary restaurant facilities that are allowed by the City of Decatur Zoning Ordinance (Ordinance #3512, as <br /> amended). Currently, food and beverage cart vendors have a permitted seasan of operation from May 1 to <br /> September 30. Staff proposes the season for these carts to be from March 15 to November 30. <br /> BACKGROiJND: The food and beverage cart vendors are permitted under the City Code because they <br /> operate in the public right of way under certain conditions regulated by the Department of Engineering and <br /> Infrastructure. The food and beverage cart vendors appear to be an asset to the downtown, offering the public <br /> a place to get lunch and enjoy the park while they eat. Staff has not received any complaints on the litter and it <br /> does not appear to be an issue as the vendors are taking care of it per City Code. Staff is of the opinion that <br /> allowing this type of business has proven to be successful for the vendors as well as the City. The following <br />' changes to the City Code are proposed. <br /> Amend Chapter 41, Section 13 (B) (5)(Food and Beverage Carts)by deleting: <br />� "Ma 1 to Se tember 30." <br /> Y P <br /> Amend Chapter 41, Section 13 (B)(5)(Food and Beverage Carts)by adding: <br /> "March 15 to November 30." <br /> Chapter 41 Section 13 (B)(5)will now read as follows: <br /> No permittee shall engage in the business of food and beverage cart vending between the hours of 9:00 P.M. <br /> and 9:00 A.M. Permitted season of operation is from March 15 to November 34. <br /> POTENTIAL OBJECTION: There are no known or expected objectors..
