No. 08-35 Petition of DECATLrR PROPERTIES OF <br /> ILLINOIS to amend the R-5 Residential <br /> Development Plan located at 3077 SOUTHERN <br /> HILLS DRIVE. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Poland. ! <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is approximately 9.5 acres and is currently develop d with multifamily units. <br /> The property is located north of Pershing Road and west of Southern ills Drive. <br /> The R-5 Residential Development Plan was approved by the City Cou cil on July 23, 1979. <br /> The ori inal R-5 RDP was to include 104 townhouse multi-famil u its with no more than six <br /> g Y <br /> (6) units in a building and all units were to have their own private entra�nces. <br /> It has come to the staff's and the property owners' attention that the RDP does not allow for a six <br /> (6) foot fence, it only allows for a four(4) foot fence. <br /> The petitioner proposes to amend the approved R-5 RDP in order to a11ow the six (6) foot fence <br /> to remain on the ro ert . <br /> P P Y <br /> The existing fence was constructed sometime in the late 1980's and is currently being repaired. <br /> The existing six (6) foot fence runs along the east and south property lines. <br /> According to the original R-5 RDP a four (4) foot fence was to be co structed on the lot lines if <br />, required. <br /> Staff believes that since the fence has been in existence for several y ars and it does not appear <br /> to have had an adverse effect on the neighborhood that cutting it dowr� to a four(4) foot fence is <br /> not necessary and would not be aesthetically pleasing. Staff is of the bpinion that the continued <br /> use of the six (6) foot fence will not be detrimental to the neighbori g properties and a six (6) <br /> foot fence is allowed by the Zoning Ordinance. <br /> Based on the analysis, the proposed Residential Development Plan am�ndment is consistent with <br /> the intent of the ori inal RDP. Staff recommends a roval of the etitilon. <br /> g PP P <br /> Section XIX.G.2. of the City of Decatur Zoning Ordinance requires th�Plan Commission to hold <br /> a public hearing to review the Residential Development Plan and report its findings concerning <br /> the effect on the comprehensive plan and compliance with the standards of review to the City <br /> Council. A motion to forward Calendar Number 08-35 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Richard Hopp, representative,was sworn in by Mrs. Poland. <br /> Mr. Hopp stated the original fence was built in 1980 and has been �iamaged. The petitioner, <br /> Decatur Properties of Illinois would like to repair the damage. Ci�y staff informed Decatur <br /> Properties of Illinois that the fence was in violation of City Ordinance� Instead of removing the II <br /> existing fence the petition proposes to amend the approved R-5 RDP. �, �i <br /> There were no questions and no objectors present. ' <br /> It was moved and seconded (Anderson/Jackson) to forward Cal. No. b8-35 to the City Council �!, <br /> with recommendation for approval as presented by staff.
