ORDINANCE NO. 2008-45 ORDINANCE GRANTING CONDITIONAL USE AERMIT - 3840 NORTH MARTIN LUTHER HING JR. D�ZIVE - WHEREAS, on the Sth day of June, 2008, upon due notic , the Decatur City Plan Commission held a public hearing upon the petition of Dan Doughe y, for a conditional use permit under the provisions of Section XXII.A.3 of the Zoning Ordina ce to allow the operation of a car wash on property located in the City of Decatur, Illinois and leg lly described as follows: The West 152.68 feet of the South 213.89 feet af Lot T o (2) of Dowd- Kaltenbach Second Addition as per plat recorded in Book 1832, Page 907 of the records in the Recorder's Office, Macon County, Illinois; and, WHEREAS, said Decatur City Plan Commission recommended that such conditional use permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY C4UNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur (�ity Plan Commission be, and the same are hereby, received, placed on file and granted. ' Section 2. That a conditional use permit be, and it is hereby, g anted to Dan Dougherty, and only to Dan Dougherty, to allow the operation of a car wash upon the premises aforesaid in accordance with the plat thereof hereto attached marked Exhibit A nd hereby made a part hereof. Section 3. That the conditional use permit be, and the same is hereby, expressly conditioned as follows: (a) The correct legal description is added to the Lighting Plan. (b) The proposed Lighting Plan cornes into compliance and meets the current Zoning Ordinance.
