Excerpts from Plan Commission Minutes of Apri13,2008 <br /> Cal.No. 08-09 Petition of JOSHUA JO ES for a Conditional Use <br /> Permit at 824 East Prairie treet for a Barber Shop. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is approximately 0.14 acres (6,066 square foot) and urrently has a 2 story brick <br /> commercial building on the site. <br /> The subject petition requests a conditional use permit to allow the use f a Barber Shop on the first <br /> floor of the building. A Barber Shop located in the R-6 District require a Conditional Use Permit. <br /> The new owners plan to have a barber shop on the first floor and plan o live on the second floor of <br /> the existing building. <br /> Section XXII.A.3. lists three standards which must be met in order to ant a conditional use permit. <br /> The first standard requires the applicant to show that the use i "necessary for the public <br /> convenience at the location." The proposed use is generally compatibl with the neighborhood and <br /> provides a service which can be utilized by area residents. <br /> The proposed use also meets the second standard. The facility is located and designed to be <br /> operated in a manner that the public health, safety and welfare will be p otected. <br /> This use also meets the third standard. The facility will not cause sub tantial injury to the value of <br /> other properties in the neighborhood. The commercial building has b en located at this particular <br /> location for a number of years. It does not appear to have ha an adverse effect on the <br /> neighborhood. The structure will be required to meet all applicable Cit codes and standards. <br /> Based on the above analysis, staff recommends approval of the pe ition as submitted with the <br /> following conditions: <br /> a. Concrete bollards must be placed in the area between the street d the sidewalk in order to <br /> prevent unauthorized parking in the front yard across the sidewalk. <br /> b. Prior to going to City Council the petitioner must go to the Traffic d Parking Commission and <br /> have successfully obtained permission for three (3) on street parki g spaces including one (1) <br /> handicapped parking space. <br /> c. The building must be brought up to ADA accessibility standards by creating an accessible route <br /> between the parking spaces and the front door. <br /> d. The petitioner must meet current City codes and standards. <br /> Section XXII.A.2. requires the Plan Commission to hold a public h aring on a conditional use <br /> permit request, and then forward its report and recommendation to the City Council for final <br /> approval. A motion to forward Calendar Number 08-09 to the City Co ncil with a recommendation <br /> for approval is suggested. <br /> Mr. Terry Smith asked if the building would be required to be broug t up to commercial code or <br /> single family code. Ms. Suzy Stickle stated she believed it would be required to have the proper <br /> separation for fire but was not sure if this was already in the building. <br /> I <br />
