ECONOMIC AND URBAN DEVELOPMENT MEM RANDUM
Memo No. 07-108
September 26, 2007
TO: Honorable Mayor Paul Osborne and City Council
FROM: Steve Garman, C anager
Greg C. Czowe, s stant City Manage
Suzan Stickle, Seni r Planner SS
SUBJECT: Rescind Ordinance for Annexation-1100 Block West Arbor Drive
Annexation— 1100 Block West Arbor Drive
SUMMARY RECOMMENDATION: Staff recommends that the atta hed annexation agreement be
approved. Staff also recommends approval of the attached annexation p tition. Staff is of the opinion
that the proposed annexation would produce a logical extension of the co orate limits.
BACKGROUND: The ordinance to rescind the annexation is necessary because staff was made
aware that proper notification was not sent to all taxing bodies. Th subject property is actually
located in the Hickory Point Fire Protection District. The proper notific tion was not sent to Hickory
Point because the City's records showed that this property had disconne ted from Hickory Point's Fire
Protection District. This petition was heard by the Council on September 4, 2007 and was approved by
a vote of 5 to 0.
A valid petition seeking voluntary annexation of the subject premises has been filed with the City
Clerk's Office. Containing approximately 15.23 acres, the property is currently undeveloped. The
property to the east is zoned R-3, Single Family Residence District; properties to the north are zoned
B-1, Neighborhood Shopping District and R-5, Two Family Residence District; properties to the west
and south are in the County. When annexed, the area will come into the city as PD, Planned
Development District. The following information is relevant to the area im question:
1. The parcel is currently undeveloped.
2. City water is available to the site. i
3. Sanitary sewer is not available. Annexation agreement will make this possible.
4. The average fire response time from the Decatur Fire Department is eight (8) minutes.
5. West Arbor Drive is asphalt and maintained by the City of Decat .
Primrose Retirement has requested City participation to extend sanitary sewer services to a proposed
senior retirement community along Arbor Drive. The proposed develop ent would include a 68-unit
independent and assisted two story apartment building with exterior garages, and 24 independent living
villa units with attached garages providing housing for seniors. All of the units are market rate.
The cost of extending sanitary sewer to the subject property is very high due to the depth of the sewer
mains. Costs to extend the sanitary sewer are expected to be $45,000. The City's responsibility to
reimburse for project expenses is limited to actual incremental property taxes generated by the new
