�„ <br /> LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2007-13 <br /> J u ly 24, 2007 <br /> TO: Honorable Mayor Osborne and City Council <br /> FROM: Steve Gar , City Manager <br /> Wendy Mort d, Corporation Counsel <br /> Amy Waks, sistant Corporation Counsel Gt� <br /> SUBJECT: Amendments to Chapter 41 — Miscellaneous treet Regulations <br /> SUMMARY RECOMMENDATION: Staff requests that ouncil pass the <br /> proposed ordinance amendment regarding Chapter 41, S ctions 18 through <br /> 20 allowing for a permit to be issued prior to outd or entertainment <br /> downtown. Further, staff requests changes to current Sec ions 18 and 19 to <br /> allow for re-numbering with the additions of the new ection and of a <br /> proposed change to current Section 19 to include the new mendment in the <br /> definition of Nuisance. <br /> BACKGROUND: Staff received complaints regarding a c ncert held in the <br /> downtown area. Without a specific permit allowing for this t pe of activity, the <br /> City is unable to regulate the hours of the activity. With a p rmit, the Decatur <br /> Police would be aware of the events and could respond app opriately. <br /> RECOMMENDATION: In order to allow for the regulation of outdoor events <br /> in the downtown area, staff recommends the suggeste amendments to <br /> Chapter 41, Sections 18 through 20. <br /> POTENTIAL OBJECTIONS: There are no known or expec ed objections. <br /> INPUT FROM OTHER SOURCES: <br /> STAFF REFERENCE: <br /> Amy Waks, Assistant Corporation Counsel, at 424-2807. <br /> BUDGET/TIME IMPLICATIONS: None <br />
