'� ' �I ORDINANCE NO. 2007-52 AN ORDINANCE PROHIBITING THE USE OF GROUNDWATER AS A POTABLE WATER SUPPLY BY T E ' INSTALLATION OR USE OF POTABLE WATER SUI�PLY WELLS OR BY ANY OTHER METHOD ' WITHIN A CERTAIN AREA IN THE CITY OF DECATUR WHEREAS, certain property within the City of Decatur, Illi�ois (the "City") located at 1550 East Pershing Road outlined on Exhibit B, has been used o er a number of years as industria] sites; and, WI�EREAS, because of said use, concentrations of certain cl erni�;al constituents in the groundwater beneath the City may exceed Class 1 groundwater qu lity staridards for potable resource groundwater as set forth in 35 Illinois Administrative Cod 620 or Tier 1 residential remediation objectives as set forth in 35 Illinois Administrative Code 42; and, WHEREAS, the City desires to limit potential threats to human health from groundwater contamination while facilitating the redevelopment and productive use of properties that are at or around the source of said chemical constituents. � NOW, THEREFORE, BE IT ORDAINED, BY T�HE CITY COUNCIL OF THE CITY OF llECATi1R, ILLINOIS: Section 1. Except for such uses or methods in existence befor� the effective date of this ordinance, the use or attempt to use groundwater as a potable water su�pply from within the area depicted on Exhibit "A", attached hereto and made a part of this Ordinance, by the installation or drilling of wells or by any other method is hereby prohibited, includinb at points of withdrawal bv the City. Scction 2. Any person violating the provisions oi�this ordinan e shall be subject to a tine of up to Five Hundred Dollars ($500.00) for each violation.
