t <br /> f <br /> LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2007-06 <br /> May 11, 2007 <br /> TO: Honorable Mayor Osborne and City Council ' <br /> FROM: Steve Gar City Manager <br /> Wendy Mort d, Corporation Counsel � <br /> Amy Waks, A sistant Corporation Counsel n�ti``'� <br /> SUBJECT: Amendment to Chapter 47— Control of Animals, Fowl nd Dogs <br /> SUMMARY RECOMMENDATION: Staff requests that Council pa s the proposed ordinance <br /> amendment regarding Chapter 47, Section 1 and add Section 31 all wing for a dog park within <br /> the City of Decatur's limits. <br /> BACKGROUND: Currently, the City of Decatur prohibits animals f om running at large. This <br /> requires that an animal be restrained when not in a building or other nclosure. In order to allow <br /> for a dog park within the City's limits, changes need to be made to all w for an animal to be "off- <br /> leash" while in this area. By designating only a specific site in whic this can occur, the City is <br /> able to manage and enforce the current requirements that an anim I not run at large in areas <br /> outside of the designated area. <br /> RECOMMENDATION: In order to allow for an off-leash dog park in he City, staff recommends <br /> the suggested language amendment to Chapter 47, Section 1 and the adoption of Section 31, <br /> which allows for an City-designated area in which an animal may be kept unrestrained. <br /> POTENTIAL OBJECTIONS: There are no known or expected objec ions. <br /> INPUT FROM OTHER SOURCES: <br /> STAFF REFERENCE: Amy Waks, Assistant Corporation Counsel, a 424-2807. <br /> BUDGET/TIME IMPLICATIONS: None. <br />
