No. 07-08 Petition of THE SALVATI N ARMY to vacate a <br /> portion of the 100 Block of South Union Street. <br /> Ms. Stickle was sworn in by Mrs. Althoff. <br /> Ms. Stickle presented the recommendation of staff: <br /> The petitioner owns the property abutting the right-of-way to the east. St. Paul's <br /> Lutheran Church owns the property abutting the right-of-way to t e west. The southern <br /> portion of the right-of-way to be vacated abuts the alley and the northern portion abuts <br /> the West Main Street right-of-way. Currently there is no access for thru traffic on this <br /> portion of the right-of-way as there is a guard rail and fencing cr ssing the right-of-way <br /> not allowing nortl�/south access. <br /> The petitioner is requesting the vacation of the 30 by 152 foot sect'on of the South Union <br /> Street right-of-way. The Salvation Army would like to utilize this portion of the right-of- <br /> way for parking in their proposed Planned Development. <br /> All utilities have been notified and have no objections to the va ation request. Utility <br /> easements will not be required. The abutting property owner has b en notified and has no <br /> objections to the proposed right-of-way vacation. ; <br /> An appraisal for the right-of-way vacation was submitted by he petitioner with an I��, <br /> estimated market value of$2,250. A second appraisal was obtai d by the City with an <br /> estimated market value of$4,100. The petitioner will pay the City of Decatur $4,100 for <br /> the vacated right-of-way. <br /> The closing of this portion of the South Union Street right-of- y does not appear to <br /> have an adverse affect on the general public. Staff is of the opinio that the best interests <br /> of the City of Decatur would be served by approving the right-o way vacation request. <br /> Staff recommends approval of the right-of-way vacation. <br /> A motion to forward the vacation request of Calendar Number 07 08 to the City Council <br /> with a recommendation of approval is suggested. <br /> Mr. Nordholm asked whether the petitioner was sent a copy of bot appraisals. <br /> Ms. Stickle responded no and that in the past staff has never sent a praisals to petitioners. <br /> Mr. Nordholm stated that he felt it would be appropriate if petition rs were sent a copy of <br /> the appraisals. <br /> Mr. Dan Homann, representative for the petitioner, was sworn in b Mrs. Althoff. <br /> Mr. Homann stated that the Salvation Army would like to utilize a ortion of the right-of- <br /> way for parking to prevent a large number of inembers from par ing on the street.
