No. 06-59 Petition of MATTHEW JA KSON dba WORLD <br /> OF POWER SPORTS to rez ne 2100, 2110, 2120 <br /> and 2140 East Pythian Aven e and 2071 and 2117 <br /> East Damon Avenue from R 2 Single Family <br /> Residence District and B-2 ommercial District to <br /> M-1 Intense Comercial-Ligh Industrial District. <br /> Ms. Kathy Miller was sworn in by Ms. Jesse. <br /> Ms. Miller presented the recommendation of staff: <br /> In February 2006 the Plan Commission recommended approval f and the City Council <br /> approved the rezoning of 2110 East Pythian Avenue to B-2 to all w for the construction <br /> of a building to handle their shipping operations for their expandi g business. <br /> Additionally properties located at 2110 and 2120 East Pythian Av�ue and 2138 and I <br /> 2146 East Damon Avenue were rezoned in 2005 from R-2 Si gle Family Residence <br /> District to B-2 Commercial District. Although not previous y stated as such, ihe �, <br /> petitioner plans to expand the warehousing capabilities of the bus'ness. Wareha.ise use is <br /> not allowed in the B-2 Commercial District. <br /> The petitioner proposes to rezone 2100 East Pythian from R-2 S ngle Family Residence <br /> to M-1 Intense Commercial-Light Industrial District and to rezo 2110, 2120 and 2140 <br /> East Pythian Avenue as well as 2071 and 2117 East Dam n Avenue from B-2 <br /> Commercial District to M-1 Intense Commercial-Light Industrial istrict to allow for the <br /> construction of a building to handle their shipping and wareho se operations for their <br /> expanding business. <br /> The Decatur Urban Land Use Plan shows the area as residential, c mmercial and <br /> industrial. The area continues to change from residential to comm rcial and industrial <br /> uses with some of the recent changes occurring in 2005 and 2006. <br /> Staff recommends approval of the rezoning of the East Pythian A nue and East Damon <br /> Avenue parcels subject to the following requirements: site, landsc ping and lighting plans <br /> for the building and parking area shall be submitted and approved y the Department of <br /> Economic and Urban Development and the Department of Engine ring and Infrastructure . <br /> before building permits are issued. <br /> The Plan Commission in its advisory role to the City Council is t make recommendation <br /> to approve, modify or deny petitions based on the requirements o the Zoning Ordirrance <br /> and the Comprehensive Plan. In rezoning petitions, effects of the approved land uses for <br /> the proposed zoning district on the public health safety and gen ral welfare of the City <br /> and its citizens need to be considered. <br />
