No. 06-56 Petition of STERLING DE ELOPMENT, LLC <br /> for Vacation of Right of Wa for 100 and 200 <br /> Block of West Marion, 100 lock of West <br /> Cleveland Avenue, 1000 Bl ck of South alley <br /> North of Marion Street <br /> Greg Crowe was sworn in by Ms. Jesse. <br /> Mr. Crowe presented the recommendation of staff: <br /> The petitioner is requesting rezoning to PD Planned Develo�ment to allow for the <br /> construction of an 80 unit retirement housing facility. The facilit will be four (4) stories <br /> and 50 feet tall,the plan includes 36 one (1) bedroom units and 4�two (2) bedroom units. <br /> One freestanding monument sign is proposed for the developm nt and will be built in <br /> accordance with the submitted sign drawings. <br /> In review of the proposed planned development the following fact rs were found: <br /> l. The proposed development is consistent with the chazac er of the surrounding <br /> neighborhood and general area. <br /> 2. Adequa.te landscaping is proposed within the frorrt yard and parking lot on the site. <br /> Additional landscaping is being provided as a buffer yard �n the west, south and <br /> north edges of the property. <br /> 3. Adequate utilities aze proposed for the development. <br /> 4. Ninety-three pazking spaces will be provided which meets e requirements of the <br /> Zoning Ordinance. � <br /> 5. The Comprehensive Plan shows the area as Light Industrial r Planned Commercial <br /> Development; however, the R-6 Multiple Dwelling District is compatible with the <br /> adjacent uses in the area. <br /> 6. The Zoning Ordinance requires an increased setback of one (1 foot over the required <br /> setback for every one (1) foot the building height exceeds 3 5 feet. The required <br /> setback is 40 feet from the front property line. The petitione is requesting to reduce <br /> the front yazd setback to 35 feet. Based on the removal of t e drive north of South <br /> Main Street and the increased green space, staff is comfort ble with the requested <br />
