Excerpts from Decatur City Plan Commission July 6, 2006. <br /> Cal.No. 06-44 Petition of KENT POPE to rezone premises commonly <br /> known as 435 East Ash Avenue from R-1 Single Family <br /> Residence District to PD Planned Development <br /> Mr. Crowe presented the recommendation of staff: <br /> The subject site is approximately 2.00 acres and is currently unimproved. In October of <br /> 2000, Land of Lincoln Credit Union petitioned to rezone the property to B-2 Planned <br /> Unit Development to construct a branch on the site. The rezoning petition was approved ' <br /> by the City Council, but construction of the proposed facility was not initiated within two I <br /> (2) years of the date of approval and the zoning reverted back to the previous zoning of '� <br /> R-1 Single Family Residential District. <br /> The requested planned development in front of the Commission is for the construction of I�i <br /> an 11,200 square foot retail facility. I <br /> A freestanding sign is proposed along Ash Avenue. The maximum height of the sign will <br /> be twenty(20) feet and the maximum area will be 100 square feet. <br /> In review of the proposed planned development the following factors were found: <br /> 1. The proposed development is compatible with the character of the surrounding <br /> neighborhood and general area. <br /> 2. To mitigate the effect on possible residential development to the south a 31 foot <br /> buffer yard with landscaping is proposed on the south side of the site. <br /> 3. Adequate landscaping is proposed within the front yard and parking lot on the <br /> site. <br /> 4. Adequate utilities are proposed for the development. <br /> 5. Fifty-six parking spaces are proposed which meets the requirements of the Zoning <br /> Ordinance. <br /> 6. The proposed development is consistent with the amended Comprehensive Plan <br /> and intent of the Zoning Ordinance. <br /> Based on the above analysis, staff recommends approval of the PD with the following <br />' condition: <br /> Final site, landscaping and lighting plans shall be reviewed by the Economic and <br /> Urban Development Department and the Department of Engineering and <br /> Infrastructure prior to construction. <br /> A motion to forward Calendar Number 06-44 to the City Council with a recommendation <br /> for approval is suggested. <br />
