No. 06-38 Petition of TONY ROMANO, 202 South Franklin Street <br /> To rezone premises commonly known as 175 South <br /> Forty-fourth Street from R-1 Single Family Residence <br /> District to PD Planned Development (R-3 Residential <br /> Development) <br /> Ms. Kathy Miller was sworn in by Ms. Jesse. <br /> Ms. Miller presented the recommendation of staff: <br /> The 1.08 acre site was recently purchased by the developer; the site is currently vacant. <br /> Country Club Villas are located to the north of the development. <br /> The petitioner is proposing the construction of four(4) single-family lots on the 1.08 acre <br /> tract. The lots will be accessed from a private drive that exits onto south 44th Street. The <br /> single-family lots will be targeted to the over 50 year-old single person or married couple <br /> with no children. The lots will be sold and owned by the homeowner and there will be a <br /> homeowners association for the maintenance of the drive and the lots. <br /> The average lot size of the four developments is approximately 11,000 square feet each; <br /> 6,000 square feet is the minimum requirement for R-3 developments. The R-3 minimum <br /> required lot width is 50 feet and the lots will meet the width requirement. The petitioner <br /> is requesting to vary the minimum required R-3 building side yard setbacks on Lot Two <br /> from seven (7) and five (5) feet to five (5) and five (5) reducing the aggregate side yard <br /> setback on Lot Two from twelve feet (12)to ten feet (10). <br /> The development design is planned to be consistent with the recently constructed Country <br /> Club Villas to the north. One single access drive will serve the four units. City water and <br /> sewers will be provided to the development. <br /> Staff believes that the proposed development is compatible with the surrounding area and <br /> will have a positive impact on the neighborhood. The plan is consistent with the <br /> comprehensive plan for low density residential development. The developer plans to <br /> maintain as many existing trees on the site as possible. The color scheme and the use of <br /> brick or stone on the facades will be similar to Country Club Villas. Fencing similar to <br /> that at the Villas will be used to tie the two developments together. <br /> South 44th Street is an existing collector street with a volume of approximately 1100 <br /> vehicles per day between East Cantrell Street and North Country Club Road. The <br /> anticipate traffic volume of five (5) to ten (10) trips per day per unit will not increase the <br /> traffic to its capacity on 44th Street. Staff believes that the existing streets are adequate <br /> to carry the anticipated traffic of the development. Vehicles from the development will <br />
