ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
Memo No. 06-127
June 14, 2006
TO: Honorable Mayor Paul Osborne and City Council Members
FROM: Steve Ga City Manager
Dane C. B AICP,Assistant City Manage
Kathy J. Mille , AICP, Senior Planner
SUBJECT: Rezonmg of 175 South 44t' Street from R-1 to PD
SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning from R-1 Single
Family Residence District to PD Planned Development. The Plan Commission voted 9-0 to recommend
approval of the petition at the June 1,2006 meeting; the Plan Commission minutes are attached.
BACKGROUND: The petitioner is proposing the construction of four (4) single-family lots on the
vacant 1.08 acre tract located to the south of Country Club Villas. The lots will be accessed from a
private drive that exits onto South 44th Street. The single-family lots will be targeted to the over 50 year-
old single person or married couple with no children. The lots will be sold and owned by the homeowner;
there will be a homeowners association for maintenance. The developer plans to maintain some of the
existing trees on the site. The color scheme and the use of brick or stone on the facades will be similar to
Country Club Villas. Fencing similar to that at the Villas will be used to tie the two developments
together. The proposed utilities are adequate to serve the development.
The petitioner is requesting to vary the minimum required R-3 building side yard setbacks on Lot Two
from seven (7) and five (5) feet to five (5) and five (5) reducing the aggregate side yard setback on Lot
Two from twelve feet(12)to ten feet(10).
South 44th Street is an existing collector street with a volume of approximately 1100 vehicles per day
between East Cantrell Street and North Country Club Road. The anticipated traffic volume of five (5) to
ten(10)trips per day per unit will not increase the traffic to its capacity on 44th Street. Staff believes that
the existing streets are adequate to carry the anticipated traffic of the development. Vehicles from the
development will not be backing out on 44th Street.
POTENTIAL OBJECTIONS: The Roszells objected to the plan at the Plan Commission meeting. They
expressed concern about increased traffic along South 44"' Street and the reduction of green space in the
area.
INPUT FROM OTHER SOURCES: The proposed plan has been reviewed and approved by the Planning
and Economic Development Division, the Engineering Division and the Fire Department.
STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at 424-2786
or at kjmiller@decaturnet.org.
BUDGET/I'IME IMPLICATIONS: None.
