• ,
LEGAL DEPARTMENT MEMORANDUM
NO. 2006-09
May 9, 2006
TO: Honorable Mayor Osborne and City Council
FROM: Steve Ga n, City Manager
Wendy M land, Corporation Counsel 1
Amy Waks, ssistant Corporation Counsel Q.Y`^'"
SUBJECT: Amendment to Chapter 50.1 —Transient Merchants
SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed
ordinance amending Chapter 50.1, Sections 7 and 8. This amendment would allow for
the inclusion of language stating the requirement for transient merchants and itinerant
vendors to acquire a license and a penalty if a license is not acquired.
BACKGROUND: It came to the attention of staff that Chapter 50.1 regulating transient
merchants and itinerant vendors did not include a statement of the requirement to be
licensed or a penalty if the ordinance is violated.
RECOMMENDATION: In order to provide for a statement of the requirement that
transient merchants and itinerant merchants be licensed as well as for a penalty if the
ordinance is violated, staff recommends the suggested language amending Chapter
50.1, Sections 7 and 8.
POTENTIAL OBJECTIONS: There are no known or expected objections.
INPUT FROM OTHER SOURCES:
STAFF REFERENCE:
Amy Waks, Assistant Corporation Counsel, at 424-2807.
BUDGET/TIME IMPLICATIONS: None.
