ORDINANCE NO. 2006-46 ORDINANCE AMENDING PLANNED SHOPPING CENTER - 4360 NORTH PROSPECT DRIVE - WHEREAS, on the 4th day of May, 2006, upon due notice, the Decatur City Plan Commis- sion held a public hearing upon the petition of Core States Engineering to modify and amend the B-3 Planned Shopping Center previously approved by Ordinance No. 90-19, and subsequently modified, on premises situated in the City of Decatur, Illinois, and described as follows: Lots One (1), Two (2), and Three (3), of Wal-mart's First Addition, as per Plat recorded I in Book 1832, Page 372 of the Records in the Recorder's Office of Macon County, Illi- � nois, and ' Lots One (1) and Two (2) of Wal-mart's Second Addition, as per Plat recorded in Book I�� 1832, Page 389 of the Records in the Recorder's Office of Macon County, Illinois, and � Lots Six (6), Seven (7), Eight (8), Nine (9) and Ten (10), of Wal-mart's Third Addition, '� as per Plat recorded in Book 1832, Page 670 of the Records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, the Decatur City Plan Commission did report its findings and did recommend that ' the modification of said B-3 Planned Shopping Center as requested be authorized. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF , DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved. Section 2. That upon the condition set forth below, the aforesaid B-3 Planned Shopping Center ' District be, and the same is hereby, modified and amended, and petitioner be, and it is hereby, author- I� ized and permitted to develop the premises described above in accordance with the site plan hereto at- '� tached, marked Exhibit A and hereby made a part hereo£ I A. That final site and landscaping plans for the site shall be submitted to and I approved by the Economic and Urban Development Department and the Department of Engineering and Infrastructure prior to the issuance of building permits.
