. +� ORDINANCE NO. 2006-28 ORDINANCE GRANTING CONDITIONAL USE PERMIT - 715 WEST DIVISION STREET - WHEREAS, on the 6th day of April, 2006, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Robin Frazier for a conditional use permit under the provi- sions of Section X.B.3 of the Zoning Ordinance to use the premises described below as a licensed large home daycare facility: Lot 15 of Block Three (3) of Homestead Place, as per plat recorded in Book 300, Page 20 of the records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, said Decatur City Plan Commission recommended that such conditional use permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and granted. Section 2. That upon the conditions set forth below, a conditional use permit be, and it is hereby, granted to Robin Frazier, and only to Robin Frazier to use said premises as a licensed large home day- care facility. A. A drop-off/pick-up area will be required along West Division Street; B. The proposed operation be in compliance with applicable provisions of the City's adopted building codes, including obtaining a building permit to perform any pro- posed or required improvements to the existing dwelling; C. That the proposed daycare be at all times appropriately licensed by the State of Illinois and a copy of that license, upon approval, will be filed with the Economic and Urban Development Department; D. The State Fire Marshall shall be contacted regarding a field inspection and a copy of the fire inspection report, upon completion, will be filed with the Fire Depart- ment;
