No. 06-19 Petition of JERRY NUZZO and BART PETERS, to <br /> rezone the premises located at 2065 South 34`n <br /> Place from R-1 Single Family Residence District to <br /> R-2 Single Family Residence District. <br /> Mrs. Vasudha Pinnamaraju was sworn in by Ms. Jesse. <br /> Mrs. Pinnamaraju presented the recommendation of staff: <br /> The subject site is a corner lot located at South 34th Place and East Orchard Drive <br /> containing approximately 27,290 square feet. The subject property and surrounding <br /> properties on the north, south, east and west are zoned R-1 Single Family Residence <br /> District. However, almost all property from Route 36 to the north, Albany Place on the <br /> west and Hilltop Drive on the east is zoned R-2 Single Family Residence District. <br /> The site was annexed in 1981; an adjacent area was annexed in 1987. When annexed, the <br /> properties came into the City of Decatur as R-1 Single Family Residence District. These <br /> properties were not rezoned to R-2 which would be the appropriate zoning. City staff <br /> will look into bringing a petition forward rezoning the area between Maryland Street, <br /> Orchard Drive, 32nd Place and Albany Place to R-2. <br /> Both R-1 and R-2 districts are Single Family Residence Districts. The minimumrequired <br /> R-1 lot size is 20,000 square feet; a minimum width of 80 feet is required. Set backs are <br /> 30 feet front yard, 20 feet rear yard and 10 feet on both side yards. The minimum <br /> required R-2 lot size is 9000 square feet; a minimum width of 60 feet is required. Set <br /> backs are 25 feet front yard, 16 feet rear yard and 8 feet on both side yards. <br /> The subject site contains a residential structure on the south side towards Orchard Drive <br /> and a vacant yard on the northern part of the property. The petitioner plans to subdivide <br /> the premises and build another house on the vacant portion of the current lot. When <br />, subdivided the proposed Lot One will contain 16,131 square feet and be 101.5 feet wide; <br /> the proposed Lot Two will contain 11,139 square feet and be 70 feet wide. <br /> The subject property and properties immediately adjacent to the subject property are <br /> zoned R-1 Single Family Residential District. These properties are surrounded by R-2 <br /> Single Family Residence District on the north, south and east. After the property is <br /> subdivided the petitioner plans to construct a single family residence which will be in <br /> harmony with the neighborhood. It appears that rezoning the property to R-2 Single <br /> Family Residence District is logical and will not have a negative impact on the <br /> surrounding area. <br /> Staff recommends approval of the request for rezoning. <br /> Mr. Jerry Nuzzo, petitioner, was sworn in by Ms. Jesse. <br />
