ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM <br /> No. 06-53 <br /> March 15, 2006 <br /> TO: Mayor Paul Osbome and City Council Members <br /> FROM: Steve Ga City Manager <br /> Dane C. ,Assistant City Manag� <br /> SUBJECT: Chapter 5 Amendment,Alcoholic Liquor <br /> Based on discussion during the March 6 City Council meeting, City staff has revised the <br /> proposed Class L liquor license. Staff is of the opinion that a more efficient way of <br /> regulating the use may be to focus on the capitalized value of the investment as opposed to <br /> utilizing sales or inventory controls which require periodic monitoring and evaluation. <br /> Further discussions with the wine shop owners indicated that a percentage restriction for beer <br /> vs. wine sales, or beer vs. microbrew sales, would be cumbersome to monitor and classify. <br /> Based on staff review of statutory definitions of types of alcohol, it would appear that the <br /> definition of distinct categories of beers or wines would be very difficult. <br /> Accordingly, a proposed ordinance amendment has been included with this memo that <br /> includes: a) a restriction requiring at least $50,000 in capitalized value by the operator and b) <br /> a restriction to no more than three(3)licenses in the B-4 Central Business District. <br /> Staff believes that this concept will achieve the goal of providing for a high-quality user in <br /> the downtown area. <br /> If you should have any questions, please do not hesitate to contact Dane Bragg at 424-2727 <br /> orviae-mail: dbra���decaturnet.or�. <br />
