E., City Enginee� <br /> SUBJECT: Water Service Agreement <br /> Addition of Baum Acres to Boiling Springs Area <br /> SUMMARY RECOMMENDATION: <br /> It is recommended by staff that the City Council approve the attached Ordinance authorizing the <br /> addition of Baum Acres to the current Water Service Agreement(City Ordinance#90-72, <br /> attached hereto) in the Boiling Springs area and authorize the City Manager and the Director of <br /> Engineering and Infrastructure to enter into Water Service Agreements within the Water Service <br /> Agreement District and that the Mayor be authorized to sign said Ordinance, and the City Clerk <br /> to attest. <br /> BACKGROUND: <br /> On June 18, 1990, the City Council authorized the establishment of a Water Service Agreement <br /> District for a portion of the Boiling Springs area of the City following the installation of a water <br /> main in the area. In December 2005, owners of Baum Acres, a small subdivision in the Boiling <br /> Springs area, approached the City for a permit to connect 3 water taps into the existing water <br /> main in Westlawn Avenue (see attached map). Members of the City Engineering staff <br /> mistakenly believed Baum Acres to be a part of the Boiling Springs Water Service Agreement <br /> District. After the connection had been authorized and installed, it was determined that Baum <br /> Acres resided just outside the Agreement District. <br /> The ordinance revision adds Baum Acres to the Boiling Springs Water Agreement District, <br /> thereby formally authorizing the water connections that have taken place. <br /> POTENTIAL OBJECTIONS: There are no known objections to this <br /> resolution and agreement. <br /> INPUT FROM OTHER SOURCES: City Legal Department <br /> City Water Management Department <br />
