The ENGINEER agrees, to the fullest extent permitted by law, to indemnify and hold harmless <br /> the DISTRICT, its officers, directors and employees (collectively, DISTRICT) against all <br /> damages, liabilities or costs, including reasonable attomeys' fees and defense costs, to the extent <br /> caused by the ENGINEER's negligent performance of professional services under this <br /> Agreement and that of its subconsultants or anyone for whom the ENGINEER is legally liable. <br /> 4. Insurance Repuirements <br /> The ENGINEER shall procure and maintain, at its expense, insurance of the types and in the <br /> minimum amounts stated below: <br /> a. Workman's Compensation Insurance in full compliance with the Workman's <br /> Compensation Act and Employers Liability coverage of not less than as defined <br /> by Illinois State Statutes. <br /> b. Comprehensive General Liability <br /> Bodily Injury $250,000/500,000 each occurrence <br /> Property Damage $250,000 each occurrence or <br /> $500,000 Single Limit Liability <br /> c. Comprehensive Automobile Liability <br /> Bodily Injury $250,000 single per occurrence <br /> Including Death $500,000 two or more,per occurrence <br /> Property Damage $100,000 each occurrence <br /> d. Architects&Engin�rs <br /> Professional Liability $1,000,000 <br /> e. Umbrella over above <br /> Items a,b and c $1,000,000 <br /> The Comprehensive General Liability policy shall include blanket contractual liability coverage <br /> or a contractual liability endorsement covering the liability assumed by the ENGINEER under <br /> this AGREEMENT, with limits not less than those specified herein. Certificates furnished <br /> hereunder shall reflect such coverage. <br /> Insurance shall be written by a company or companies satisfactory to the DISTRICT. Before <br /> commencing any work hereunder, a certificate evidencing that maintenance of said insurance <br /> shall be furnished to the DISTRICT,and shall contain the following statement: <br /> "Insurance evidenced by this certificate will not be canceled or altered unless 30 <br /> days written notice is given to the certificate holder and the additional insured." <br /> Policies for Items b&c above must name the DISTRICT and City of Decatur as an additional <br /> insured during the life of this AGREEMENT. <br /> BGM 08-071 ENGAGREE-2 <br />
