<br /> THIS AGR��MENT made at Decatur. Illinois, this 17"' day of December, 2008, by and between the
<br /> 5anitary District of Decatur, hereinafier referred to as the "DISTRICT" and Bainbridge, Gee,
<br /> Milanski & Associates, Inc., 1670 South Taylorville Road, Decatur, Illinois 62521, hereinafter referred �

<br /> to as the "�NGIN��R," WITNESSETH: ,
<br /> The DISTRICT proposes to en�age the ENGINEER to provide professional engineering assistance in
<br /> the preparation of construction plans and specifications for the replacement of the K-Mart Pumping
<br /> Station at its current location with new wet well, valve vault, pumps, and controls. Standby power and
<br /> control panel are not included. This is hereinafter referred to as the PROJECT:
<br /> THEREFORE, In Consideration of these premises and the mutual covenants of the above described
<br /> PROJECT:
<br /> THE ENGINEER AGRE�S,
<br /> 1, Proiect EnaineerinQ Services - To �erform or be responsible for the performance of the
<br /> following professional engineering services for the DISTRICT in connection with the desian of
<br /> the proposed projects hereinbefore described:
<br /> a. Make such detailed surveys as are necessary for the preparation of detailed construction
<br /> plans.
<br /> b. Prepare detailed construction drawings and specifications in such a manner as to permit -
<br /> the DISTRICT to obtain construction bid prices for tl�e above described PRO.TECT.
<br /> c. Prepare proposal forms, notice to bidders, and the Contract Documents.
<br /> d. Prepare estimate of project construction cost based on final plans and documents.
<br /> e. Fun�ish copies of the Contract Documents consisting of Construction Agreement Forms,
<br /> General Conditions, Special Conditions, Detailed Construction Plans and Specificatioils
<br /> for review by the DISTRICT, and for submission to permitting authorities.
<br /> f. Incorporate DISTRICT's review comments into the final set of contract documents.
<br /> g. Assist the DISTRICT �vith necessary permit applications to all governmental and other
<br /> �� • T such as. but not

<br /> limited to, the Illinois Environmental Protection A`,ency and City of Decatur. "

<br /> 2. Standard of Care - That they have the skills and eYpei-tise, and the necessar�� trained personnel ��
