32. Owner(s) shall comply with all of the provisions of the Department of Housing <br /> and Urban Development regulations identified in 24 CFR Part 92 and 24 CFR <br /> Part 570, as now written or subsequently amended. <br /> 33. Owner(s) shall submit conduct and submit to City, an annual tenant survey, in <br /> a manner prescribed by City, describing the socioeconomic characteristics of ' <br /> the tenants, and the monthly rent charged for each unit. ' <br /> 34. Owner(s) shall make their books and records available for inspection by an ' <br /> authorized representative of City. Owners' obligation is further described in <br /> 24 CFR 92.504 C. , <br /> 35. Owner(s) are advised that all amounts recaptured as a result of the property I <br /> being sold or transferred prior to the conclusion of the affordability period �I <br /> shall be used by City only for other CDBG eligible projects, and shall not be I, <br /> used by City for planning or administrative costs. ! <br /> 36. Owner(s) shall comply with all Federal laws and regulations regarding the <br /> Rental Rehabilitation Program, and with all policies and procedures <br /> established by the City necessary to administer and monitor the Rental <br />' Rehabilitation Program. ', <br /> 37. Owner(s) shall neither assign nor transfer any interest in this Agreement � <br /> without City's prior written approval, during the affordability period. In the �, <br /> event Owner(s) or either of them shall make any assignment or transfer of ' <br /> Owners' interest in the property subject to this Agreement during the '� <br /> affordability period, without the City's prior written consent, all amounts I, <br /> received hereunder shall be immediately due and payable to City. I <br /> 38.To the greatest extent permissible under law, the affordability period <br /> restrictions included in this Agreement shall remain in full force and effect <br /> until released by City at the end of the one (1) year affordability period. In the <br /> event the property shall be foi•eclosed upon, or transferred in lieu of <br /> foreclosure, prior to the end of the affordability pe1-iod, the entire amount of <br /> the loan shall be immediately due and payable. <br /> 39. City may terminate this Agreement for any of the following reasons effective <br /> immediately without advance notice: <br /> a) Owner(s) has or have furnished any statement, representation or <br /> certification in connection with this Agi-eement which is materially false, <br /> deceptive, incorrect or incomplete; <br /> b) City determines that the actions or failure to act, by Owner(s), their <br /> agents, employees or subcontractors have caused, or reasonably could <br /> cause jeopardy to health or safety. <br /> 40.The occurrence of any one or more of the following events shall constitute <br /> cause for the City to declare Owners in default of their obligations under this <br /> Agreement: <br /> 6 <br />
