II. RIGHTS AND OBLIGATIONS <br /> The parties hereby agree to the following: <br /> A. That the MS4's retains the right of final decision on lands the MS4's owns or <br /> exercises control over in regards to the use and management of soil, water, and other <br /> natural resources, as well as any issues, opinions, findings, or actions resulting from this <br /> Memorandum, including enforcement of all ordinances and regulations regarding soil <br /> erosion and sediment control. <br /> B. To comply with the nondiscrimination provisions as contained in Titles VI and <br /> VII of the Civil Rights Act of 1964, as amended, the Civil Rights Restoration Act of 1987 <br /> (Public Law 100-259) and other nondiscrimination statutes, namely Sections 504 of the <br /> Rehabilitations Act of 1973, Title IX of the Education Amendments of 1972 the Age <br /> Discrimination Act of 1975, and in accordance with regulations of the Secretary of <br /> Agriculture (7CFR-15, Subparts A&B) which provide that no person in the United States <br /> shall, on the grounds of race, color, national origin, age, sex, religion, marital status or <br /> disability be excluded from participation in, be denied the benefits of, or be otherwise <br /> subjected to discrimination under any program or activity, receiving Federal financial <br /> assistance from the Department of Agriculture or any agency thereof. <br /> C. That except as provided herein or mutually agreed upon, no charges or fees for <br /> labor, equipment, wages, or materials will be billed by or to any other party specifically <br /> included in this Memorandum. <br /> D. That this Memorandum shall become effective on the date of the last signature <br /> affixed hereto. This Memorandum may be modified at any time by mutual written <br /> consent of the parties hereto. Any party may terminate this Memorandum, by sending <br /> thirty (30) days written notice by first class mail to the other parties. In the event of a <br /> termination by any MS4, the Memorandum shall continue in full force and effect with the <br /> remaining parties. Following the issuance and receipt of a request for amendment or a <br /> notice of termination, a meeting of the officially designated representative of all parties <br /> will be called. <br /> E. That no party to this Memorandum shall assign this Memorandum, nor any <br /> interest arising herein, to any other party without the prior written consent of all parties <br /> involved. <br /> F. That nothing herein contained is intended or should be construed as in any <br /> manner creating or establishing a relationship of copartners between the parties, or as <br /> constituting the District (including its officers, employees and agents) the agent, <br /> representative, or employee of the MS4 for any purpose or any manner, whatsoever. <br /> Likewise, nothing contained herein is intended or should be construed as constituting any <br /> of the MS4's (including its officers, employees, and agents) as an agent, representative, <br /> or employee of the District or of any other MS4 and each MS4 shall remain and shall <br /> 2 <br />
