AMENDMENT TO LEASE <br /> « ,� � <br /> THIS AMENDEMENT TO LEASE (this Amendment ) is entered into <br /> day of October, 2008, by and between JOYNER RADIO, INC. ("JOYNER") and the <br /> CITY OF DECATUR, an Illinois home rule municipal corporation (the <br /> "Municipality"). <br /> RECITALS <br /> A. ABG ILLINOIS, LLC ("Archway") and Municipality entered that Lease <br /> dated March 5, 2007 (the "Lease"), for the purchase of the leasing a m�imum of 35 <br /> Parking Spaces in Parking Garage B located at the northwest corner of Water and North ' <br /> Streets, City of Decatur, Illinois. I <br /> B. Joyner and Municipality desire to amend the agreement to replace II� <br /> Archway with Joyner the successor of the Lease in all applicable locations. �, <br /> C. Joyner and Municipality desire to amend paragraph l.a of the Lease to I, <br /> provide that Joyner shall have the option to lease less than 27 Parking Spaces. <br /> D. Joyner and Municipality further desire to amend paragraph 3 of the Lease <br /> to provide Joyner the option of leasing less than 27 parking Spaces at a rate of Twelve <br /> Dollars ($12.00) per leased pazking space per month. The Amendment further changes <br /> Joyner's lease payment from a.nnually to monthly. <br /> AGREEMENT <br /> NOW THEREFORE, in consideration of the above Recitals, mutual promises, <br /> warranties and terms set forth herein, together with other good and valuable <br /> consideration, the receipt and sufficiency of which aze hereby acknowledged, the parties <br /> hereto represent, covenant, warrant and agree as follows: <br /> 1. As successor of the Lease, JOYNER RADIO INC. ("Joyner") replaces <br /> ABG ILLINOIS, LLC ("Archway") in all applicable locations of the <br /> Lease. <br /> 2. Section l.a of the Lease, which currently provides as follows: <br /> "A maximum of 35 Parking Spaces in Pazking Garage B located at <br /> the northwest corner of Water and North Streets, City of Decatur, <br /> 1 <br />
